DuPont – patent cancellation and infringement disputes

Representing a world-known international manufacturer of chemical products – DuPont in a number of patent disputes, including patent cancellation cases and patent infringement cases aimed at prohibition to market and distribute counterfeit products (means of crop protection) imported from China. The cases have required profound expertise in the agrochemical sector and organic chemistry and thorough work with experts, as well as complex evidence. In one of the cases the Superior Commercial Court of Ukraine issued a precedential decision allowing cancellation of marketing authorization for herbicides infringing a patent even when no statutory rule regarding obtaining of the marketing authorization as such was infringed.
