Vasil Kisil and Partners Successfully Defended OnlyFans Model in Tax Dispute Worth Nearly UAH 8 Million

Vasil Kisil and Partners’ lawyers’ team successfully represented the interests of an OnlyFans platform model in a tax dispute with the State Tax Service of Ukraine amounting to over UAH 7.8 million.

The Fifth Administrative Court of Appeal upheld the firm's lawyers' position and canceled the tax notices-decisions issued based on the results of a documentary unscheduled off-site audit of the model's income from Odesa.
The tax authority relied on information from the United Kingdom regarding the alleged income she received from OnlyFans for 2021-2022 in the amount of over USD 1 million, but the court deemed this data insufficient without specifying transactions, evidence linking them to the plaintiff, and primary documents.
The case is exemplary for the practice of taxing income from digital platforms and underscores the importance of tax authorities adhering to evidentiary standards.
